Telstra policy: when is TIO complaint necessary/vaild?

I’m on a cable plan with Telstra at $90/mnth. I’m moving but found out there is only Telstra ADSL1 (not 2) available at new place due to no free ports in the exchange. Optus says they can do ADSL2 though. Telstra won’t let me out of my contract without penalty since they can provide “at least 2Mbps”. But I still get to pay full price for a super downgrade. I have 1.5 years left on contract. Break fee is $270+. Their reps can’t seem to tell me where in the T&Cs it says they can get away with this: ie. downgrade and charge full price.
